You know it's getting pretty bad for smokers when people are trying to ban them from smoking in their own homes. Apartments I can sort of understand as you are renting from someone. However, a Condo that you've bought and paid for, no one, not even those loathed home owners associations, can tell me what I can and can't do in my home.
If they want to tell me what I can and can't do in my home, then they can pay my mortgage payment. I had the same problem when I was living in my old condo. My homeowners association tried to tell me I had to bring my garbage cans up the same day that the garbage was picked up.
Unfortunately for them, I am the worst person to play the "waiting game" with. My homeowner's association rep came to my house and tried to tell me about the "garbage can problem". I told her if she didn't like the cans at the side of the street past the day of pickup, she was more than welcome to bring them up to my garage door.
She then tried to play the "let's leave a note on the door every day" bit. That only gives me something to look forward to at the end of the day.
After a while, she simply accepted that I work for a living and that I'll get my garbage cans when I'm God damned good and ready.
The same should apply to smokers who paid for their condos. Unless you plan on making their mortgage payment, you have zero right to ask them to curb whatever behavior they are doing. It's not illegal, so leave them alone.
