They are trying US soldier Spc. Mario Lozano for his role in the shooting death of Nicola Calipari because Mr Calipari was involved in a rescue operation of Giuliana Sgrena and was speeding towards Mr. Lozano's checkpoint. Mr. Lozano claims that he first fired at the ground of the speeding car, then the car engine, then into the occupants.
The Italians claim that the car wasn't speeding and that the soldiers didn't signal there was a checkpoint.
"You have a warning line, you have a danger line, and you have a kill line," Lozano told the New York Post in an interview published earlier this month.
That's pretty straight forward to me. If you see US soldiers and a line of cars, it would make me think there was a checkpoint. Also, it's pretty easy to determine if what Mr. Lozano is saying is the truth. Check the car's engine. He said he fired at it, so therefore, there should be a bullet hole somewhere. If that's the case, he fired a warning shot and the driver should have stopped. Maybe I missed my calling as a trial attorney.....Nah.
