Rove Refuses Subpoena

Karl Rove, President Bush's longtime political guru, refused to obey an order to testify before a House Judiciary Committee hearing Thursday.

Karl Rove's lawyers says he is immune from a congressional subpoena.

Rove's lawyer asserted that Rove was "immune" from the subpoena the committee had issued, arguing that the committee could not compel him to testify due to "executive privilege."

Not a lot of people know what that is, so I’ll give a rough explanation.  If you are running a business, the country, whatever, you have conversations that you want to remain private for a variety of reasons.  There the right of “executive privilege”.  The Supreme Court has said that it’s a part of the “separation of powers” as spelled out in the Constitution.

Basically, that means that the President can refuse to talk about conversations he has with others in his inner circle.  That allows the President to speak candidly to others and get the best possible information about what’s going on, without having to worry whether or not what he’s saying is going to be made public.

Karl Rove is saying that he’s not going to testify because of that right.

Whether or not he’s going to be able to get away with it, is another thing though.

Of course, others don’t see it that way:

Let's say I received a subpoena from the Justice Department today telling me I had to testify about matters it considered vital to national security.

Let's say I told them, "I could give a rat's ass about your subpoena, blow me."

What do you think would happen?

I would be in Guantanamo dining on that "cockmeat sandwich" that Harold and Kumar avoided.

So why is Karl Rove walking around free today? Because the Democrats talk a good game but when it comes to taking action, they fail time and time again.

It's simple. Congress tells you that you have to testify? You testify. It's the law. Period.

First off, it’s not about national security, AND you aren’t in the President’s inner circle of aides, so it’s a different set of rules for you.  If you can’t see that, then perhaps you should read up on US law.

I’m not saying Rove shouldn’t be compelled to testify if it’s legal, but when he invokes “executive privilege”, you need to make sure that what you’re asking for is legit or not.
